WELCOME TO HI-FELLA, BY REGISTERING ON THE WEBSITE <\/strong>WWW.HI-FELLA.COM<\/a> AND\/OR THE HI-FELLA MOBILE APPLICATION (\"PLATFORM\") AND\/OR ACCEPTING THESE TERMS AND CONDITIONS, USERS AGREE THAT THEY HAVE READ AND UNDERSTOOD ALL OF THE TERMS AND CONDITIONS AND HAVE AGREED AND CONSENTED TO COMPLY WITH AND BE BOUND BY THE TERMS AND CONDITIONS BELOW:<\/strong><\/p>

This Platform is provided by <\/span>PT Hifella Firm Network<\/strong> or its affiliates (collectively, this entity will be referred to as \"<\/span>Hi-Fella<\/strong>\"). <\/span>THESE TERMS AND CONDITIONS <\/strong>are agreed upon between Hi-Fella and the Users.<\/span><\/p>

Hi-Fella and Users may individually or collectively be referred to as Parties and together as the Parties.<\/span><\/p>

THIS AGREEMENT GOVERNS THE TERMS AND CONDITIONS THAT ALLOW USERS TO ACCESS AND USE THE PLATFORM AND THE RELATED WEBSITE, SERVICES, APPLICATIONS, PRODUCTS, AND CONTENT (\"SERVICES\").<\/strong><\/p>

As visitors and\/or users of Hi-Fella, regarding the collection, use, and sharing of personal data, Users are subject to the <\/em><\/strong>Privacy Policy.<\/em><\/strong><\/p>

The Parties agree that the terms and conditions are as follows:<\/span><\/p>

Scope<\/strong><\/p>

These Terms and Conditions apply to the Agreement between Hi-Fella and Users regarding the Services provided by Hi-Fella to Users.<\/span><\/li>
Users may not assign, transfer, or subcontract all or any part of the rights and\/or obligations agreed upon in these Terms and Conditions without prior written notice and written consent from Hi-Fella.<\/span><\/li>
Users will provide information to Hi-Fella, including but not limited to telephone numbers, email addresses, and residential or domicile addresses, which must be provided correctly, completely, and accurately.<\/span><\/li><\/ol>

<\/p>
Membership Mechanism<\/strong><\/p>
1. The registered account password must be stored and kept confidential by each User for the duration in which the User uses the Platform. Users must keep the password confidential and not allow third parties or other parties to use it without the User's knowledge. Therefore, Users are fully responsible for the use and\/or actions taken by those who use the password, and if the password is compromised, Users must immediately change it. In this case, Users must immediately notify through the Contact form on the Platform if they know, suspect, or have a reason to believe that their password is known or compromised or that there has been unauthorized use of the password.<\/span><\/li><\/ol>

  Content Policy<\/strong><\/p>
  1. Hi-Fella reserves the right to remove or disable access to User content without prior notice to the User. Further details are provided in the <\/span>Sanctions for Users <\/strong>section.<\/span><\/li><\/ol>

    Premium Subscription Membership<\/strong><\/p>
    1. The User may cancel the Premium Subscription at any time and will continue to have access to the Service until the Subscription Status ends. Payments are non-refundable, and we do not provide refunds for any unused membership periods. <\/span><\/li><\/ol>

      <\/p>
      Digital Marketing Service Policy<\/strong><\/p>
      1. All activities conducted through the User Account, including purchases made or charges incurred.<\/span><\/li><\/ol>
        
        <\/p>
        By using the Digital Marketing Service, Users understand and agree that any Ads uploaded by Users on the Platform are the personal responsibility of the User, and Hi-Fella is released from any issues that may arise from it.<\/span><\/li>
        If the User purchases Digital Marketing Services, the User agrees to pay the fees and taxes associated with the specified billing.<\/span><\/li>
        The payment method used will be an active, valid, and accepted payment method, which may be updated from time to time and may include payment through the User's account with a third party.<\/span><\/li><\/ol>
        
        <\/p>
        Marketing Intelligence Service Policy<\/strong><\/p>
        Hi-Fella provides Marketing Intelligence Services, which are included in the Subscription Service or learn more about <\/span>Marketing Intelligence Service <\/strong>(\"Marketing Intelligence Service\").<\/span><\/li>
        The Marketing Intelligence Service will automatically renew at the end of the current subscription period, unless the User cancels the Marketing Intelligence Service before the end of the subscription period.<\/span><\/li>
        If the User purchases Marketing Intelligence Services, the User agrees to pay the fees and taxes associated with the specified billing.<\/span><\/li>
        Users understand and agree that the Data collected by Hi-Fella from global trade from multiple legitimate sources and through independent market analysis is solely intended for informational and insightful purposes for Users. Hi-Fella does not have the intention to harm or disclose sensitive information. The use of this Data is strictly limited to providing valuable information, analysis, and insights to empower Users in the business decision-making process.<\/span><\/li>
        Users are required to maintain confidentiality and are not allowed to disseminate any information shared by Hi-Fella through the Marketing Intelligence Service.<\/span><\/li>
        Users will be fully responsible and release Hi-Fella from any legal claims if any issues related to the Marketing Intelligence Service arise in the future.<\/span><\/li><\/ol>
        
        <\/p>
        Content Policy<\/strong><\/p>
        Users may be allowed to upload, post, or otherwise make content available through the Service, including, without limitation, any text, photos, videos, and musical works found in videos containing privately stored sound recordings from your personal music library or from the surrounding environment (\"User Content\").<\/span><\/p>

        Hi-Fella is committed to providing a platform that supports positive interactions and values the safety, well-being, and diverse perspectives of Users. This Content Policy outlines guidelines for acceptable content within the Platform. Further details will be provided in the <\/span>User Prohibitions<\/strong> section.<\/span><\/p>
        
        <\/p>
        Respect for Others: Users must respect the rights and dignity of others. Harassment, hate speech, discrimination, threats, or any form of harmful behavior towards individuals or groups based on race, gender, religion, ethnicity, sexual orientation, or any other characteristic is strictly prohibited.<\/strong><\/li>
        Child Safety: Content that endangers the safety and well-being of minors or violates child protection laws is not allowed. This includes but is not limited to child exploitation, child pornography, or any form of abuse towards minors.<\/strong><\/li>
        Privacy and Personal Information: Users should not share personal information about others without consent, including addresses, phone numbers, or any other private data. Do not engage in doxing or any activities that invade someone's privacy.<\/strong><\/li>
        Intellectual Property: Users are expected to respect copyright and intellectual property rights. Do not post or share copyrighted material without proper authorization. Provide proper attribution when sharing content that isn't your own, and only share content you have the right to distribute.<\/strong><\/li>
        Nudity and Sexual Content: Explicit or adult content, including nudity, sexual content, or sexually explicit language, is prohibited. Our application is intended for a broad audience, including minors.<\/strong><\/li>
        Violence and Harm: Do not share content that promotes or glorifies violence, self-harm, suicide, terrorism, or any illegal activities. Threats of physical harm towards others are strictly prohibited.<\/strong><\/li>
        Spam and Misleading Content: Avoid spam or misleading content, including clickbait, false advertising, or deceptive practices. Promotional content should be relevant and valuable to the community.<\/strong><\/li>
        Impersonation: Do not impersonate another individual, organization, or entity to deceive or harm others.<\/strong><\/li>
        Reporting Content: If you come across any content that violates these guidelines, please report it to the administrators or moderators. Do not engage in public confrontations.<\/strong><\/li>
        Comply with the Law: Users are expected to adhere to the Jurisdictional Terms set forth by the laws of the Republic of Indonesia when using the Platform. This includes, but is not limited to, issues related to content, copyright, defamation, and online behavior.         Prohibitions for Users<\/strong><\/p>
        The following prohibitions apply to Users when using the Hi-Fella Platform. Users are prohibited from:<\/span><\/p>
        Presenting themselves as an identity that does not correspond to the User's legally registered identity.<\/span><\/li>
        Impersonating another identity or providing inaccurate information.<\/span><\/li>
        Engaging in illegal activities, misleading actions, deceptive behavior, or actions for illegal or prohibited purposes.<\/span><\/li>
        Violating our terms or policies.<\/span><\/li>
        Disrupting or damaging the proper operation of the Service.<\/span><\/li>
        Attempting to create an account or access or collect information unlawfully.<\/span><\/li>
        Selling, licensing, or purchasing accounts or any data obtained from Hi-Fella Services.<\/span><\/li>
        Posting personal information of others without consent or engaging in any activity that violates the rights of others, including intellectual property rights.<\/span><\/li>
        Posting anything containing software viruses, worms, or other harmful <\/span><\/li>
        code.Uploading viruses or malicious code, using the service to send spam, or engaging in any activity that may disable, overload, disrupt, or damage the proper functioning, integrity, operation, or appearance of the service, systems, or our Services.<\/span><\/li>
        Using bots or other automated methods to access the Service, add or download contacts, send or resend messages.<\/span><\/li>
        Using proxies, request, or gather usernames or passwords, or misuse access.<\/span><\/li>
        Regarding the above prohibitions, based on these Terms and Conditions, if a User is found to have engaged in such actions, Hi-Fella will impose sanctions as provided in the provisions below.<\/span><\/li><\/ol>
        
        <\/p>
        Sanctions for Users<\/strong><\/p>
        If a User violates these Terms and Conditions, Hi-Fella may take one or more of the following actions against the User, including but not limited to:<\/span><\/p>
        Temporarily disabling the account.<\/span><\/li>
        Deleting the account.<\/span><\/li>
        Removing any content or information that the User has shared on the Platform Service.<\/span><\/li>
        Restricting User activities on the Platform.<\/span><\/li>
        Suspending and terminating the account.<\/span><\/li>
        Legal claims, both criminal and civil.<\/span><\/li><\/ol>
        
        <\/p>
        The sanctions imposed on the User do not waive the rights of Hi-Fella and\/or any aggrieved party to pursue other legal claims against the User.<\/span><\/p>
        
        <\/p>
        Language<\/strong><\/p>
        This Terms and Conditions is made in 2 (two) languages, namely Indonesian and English. In the event of any interpretation discrepancies, the Indonesian version shall prevail.<\/span><\/p>
        
        <\/p>
        Updates to the Terms and Conditions<\/strong><\/p>
        These Terms and Conditions may be amended and\/or updated without prior notice, and Hi-Fella will post the amended and updated Terms and Conditions on the Platform. The amended Terms and Conditions will take effect immediately upon being posted on the Platform. All Users are required to read the Terms and Conditions periodically as they may change at any time without notice to Users, and Users agree to the changes in these Terms and Conditions.<\/span><\/p>
        
        <\/p>
        Governing Law<\/strong><\/p>
        These Terms and Conditions are governed and construed in accordance with the laws of the Republic of Indonesia, and Users agree to submit to the jurisdiction of the courts of the Republic of Indonesia.<\/span><\/p>
        
        <\/p>
        Severability<\/strong><\/p>
        If any provision of these Terms and Conditions is deemed to violate the law, void, or for any reason unenforceable under the laws of the Republic of Indonesia, that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions in the Republic of Indonesia or the validity and enforceability of that provision under the laws of any other jurisdiction.<\/span><\/p>

        Intellectual Property Rights<\/strong><\/p>
        Users acknowledge and agree that everything seen or read on this Platform is protected by Intellectual Property Rights. The Intellectual Property Rights to this Site and the materials therein are owned by Hi-Fella and respective Users unless otherwise stated.<\/span><\/p>
        
        <\/p>
        Hi-Fella owns Intellectual Property Rights in the Service. Trademarks and other logos used in connection with the Service are trademarks of their respective owners. Hi-Fella, the Logo (icon), and \"Hi-Fella,\" as well as other trademarks, graphics, and logos of Hi-Fella used for our Services, are trademarks or registered trademarks of Hi-Fella.<\/span><\/p>
        
        <\/p>
        Force Majeure<\/strong><\/p>
        Hi-Fella and Users shall be released from their obligations to comply with these Terms and Conditions if it is proven that there are circumstances beyond human control, including but not limited to government regulations, acts of God (disasters, natural calamities), attacks, warfare, labor strikes, and others. The party affected by such events must notify the other party, no later than 1 (one) working day from the occurrence of such circumstances, for it to be considered as Force Majeure.<\/span><\/p>
